I think I experienced sexual harassment - but how do I know?
There is four-step process to determining whether any particular act constitutes sexual harassment. Ask yourself:
(1) That the harassment would not have occurred but for the employee's gender or sexual orientation;
(2) The actions taken against the employee were severe or pervasive enough to make;
(3) A reasonable person (under your category) believe that;
(4) The conditions of employment are altered and the working environment is hostile or abusive.
Attorney Jamison M. Mark represents employees who suffer sexual harassment and discrimination based on the following protected categories: race, sex, religion, disability, pregnancy, age, sexual orientation, national origin, creed, military reserve status, or if you are perceived to be a member of any of these categories.
What constitutes sexual harassment?
Lawyer Mark represents clients against two types of sexual harassment:
(1) Quid Pro Quo: when a boss or supervisor requests sexual favors in exchange for preferential treatment, for example, a promotion, raise or not firing an otherwise ineffective worker
(2) Hostile work environment: when an abundance of overtly sexual comments, jokes and screensavers make it difficult for a member of a protected class to function in the workplace.
You may be subject to inappropriate touching and other behaviors. If you feel degraded or mistreated in your workplace because of your gender or sexual orientation, you may have a claim. A straight employee, for example, may be sexually harassed by a gay supervisor.
Everyone has the right to feel safe in the workplace.
