About the FMLA and the New Jersey Leave Act
The Family Medical Leave Act (FMLA) says that employers have to provide employees with 12 weeks of unpaid leave in the event of an accident, illness or for maternity leave. If your spouse, child or an elderly parent in your care falls ill, you can take 12 weeks off.
The New Jersey Leave Act also provides 12 weeks off - in addition to the 12 weeks you get under the FMLA. That means that if your medical condition lasts long enough, you can take a total of 24 weeks off work to recuperate or care for the ill family member. There are exceptions to this rule. For instance, companies of fewer than 50 employees are exempt from this rule. Additionally, an employee must have worked at a company for 12 months before being able to take advantage of this leave.
Your employer has rights, too…
Your employer can ask for medical documentation, and they can make you fill out paperwork. This is to keep people from abusing the system. But as long as you provide the information they need, they have no right to deny you leave.
