New Jersey Employment Law Rights

The Law Offices of Jamison M. Mark fights hard for clients in issues of employment law including:

Unemployment benefits

Every New Jersey employer is required by law to pay into the Unemployment Compensation program. It provides benefits to employees who have been terminated from employment due to financial issues, a Reduction in Force or RIF or for no reason given. If any employer pressures employees into waiving or releasing the right to Unemployment Compensation, there may be grounds for a wrongful termination claim.

If you are an employee and your unemployment benefits run out before you find a new job, you may be able to file for up to 20 weeks of emergency unemployment benefits funded by the federal government. If you received a severance payment after leaving your employer, you are not disqualified from receiving Unemployment Compensation.

Workers' Compensation

If you are injured on the job, you may be entitled to Workers' Compensation benefits. It may pay for continued medical treatment, temporary benefits while on leave from work and a monetary settlement at the end of the case.

Wage and Hour rules

New Jersey has strict laws on wages. The minimum wage of $7.25 per hour as of July 24, 2009, must be paid to hourly workers, and overtime for more than 40 hours of work. Independent contractors are not subject to this rule.

Employees who suffer retaliation for complaining about not getting paid, are encouraged to contact employment law lawyer Jamison M. Mark for help to recover damages.

Prevailing wage claim

If you are employed on a public works projects, you are entitled to receive a Prevailing Wage set out in a contract. If you are paid less than the Prevailing Wage, you and other employees may be entitled to sue your employer for unpaid wages, costs and attorney fees.
