Criminal Law and Municipal Court Hearings
It is an unfortunate and troubling experience to be stopped for a traffic violation, arrested on drug charges, or to have been charged with a crime. Prior to entering into the practice, one of the firm's partners, Jamison Mark ,was an Assistant Deputy Attorney General, where he gained valuable trial experience. The firm knows how to protect them.

What you can expect -
It is true that the majority of criminal law cases settle prior to trial. Mark & Galusha, LLC will work with prosecutors to negotiate the most favorable plea for you. In cases where evidence was obtained illegally, the lawyers will work to suppress the evidence against you. But if the prosecutor will not agree to a reasonable plea bargain, the attorneys have extensive experience as trial lawyers. They won't hesitate to take your case to court.
The firm tries to make your experience as smooth as possible; the lawyers will explain the realities of the charges you are facing, and the possibility of a fine, community service, or even jail time. The firm is dedicated to giving you the priority your case deserves.
You have rights!
For all cases in the Municipal courts of New Jersey, you have the following rights:
- The right to know the accusation against you;
- The right to remain silent concerning your accusation (remember, anything you say may be used against you)
- The right to retain an attorney
- The right to prepare a defense and subpoena witnesses to testify on your behalf
- The right to testify or not testify on your behalf ("pleading the fifth"). A decision not to testify cannot be used against you
- The right to a trial
At Municipal Court, you will not have a jury trial. Your case will be heard before a judge. At the Superior Court level, or if you have been indicted, you are entitled to a jury trial. It is the state’s burden to prove beyond a reasonable doubt that you committed the crime as charged. If the state does not meet its burden, the judge will determine that you are not guilty.
If your rights have been violated the case against you can be dismissed. To schedule an appointment, call 201-787-9406, 908-626-1001 or toll free 888-734-8287, or contact Mark & Galusha, LLC, online.
