Workers’ Compensation is a state mandated, employer-paid benefit system for employees who are injured or who contract an occupational disease while working. An injured employee has the right to receive medical care, temporary disability payments, permanent partial benefits and/or permanent total benefits from disability resulting from their injury.

An injured worker should then find an attorney who can file a formal claim petition, enforce your medical treatment rights, or fight for your benefits with the New Jersey Division of Workers’ Compensation. By law, attorney's fees are be fixed by the court only if a compensation award is made to the injured worker, usually at 20% of the award.
