In a Middlesex County lawsuit, a woman who fell over a vacuum hose left in the doorway of her workplace, settled her case for $840,000 with the cleaning service responsible for leaving the vacuum hose at her place of employment. The Plaintiff tore her right rotator cuff and underwent surgeries in February 2006 and October 2007 on her right shoulder and biceps tendon, and underwent subsequent physical therapy. She further claimed that because of her injury, she overused and injured her left arm, which required elbow surgery in 2008. Additionally, in 2009, she required additional surgery on the right shoulder. Lastly, she claimed that she aggravated her shoulder injury in 2010 during a fall at home. The defense claimed that the only injury related to the fall was the first injury and the initial surgery related to that injury.
The Plaintiff settled her workers' compensation claim with her employer. In this case, as in all worker's compensation cases, she was precluded from filing a personal injury complaint against her employer.
