Congressman Hank Johnson of Georgia has introduced a bill titled the Fair Employment Act of 2011, which would create a new class of protected individuals from civil rights violations under the Civil Rights Act of 1964 - the unemployed. The bill cites various cases of employers discriminating against unemployed individuals when looking to fill open job positions. For instance, some job listings stated that the applicants must be currently employed or that “no unemployed candidates will considered at all.”
The New Jersey Legislature has recently passed a bill that prohibits employers from discriminating against unemployed individuals when advertising for available jobs. The bill prohibits an employer from publishing a job advertisement that states that unemployed individuals may not apply and authorizes a $1,000.00 fine for a first offense of discrimination and $5,000.00 for subsequent offenses. If Congressman Johnson’s bill passes and becomes law, this would broaden the protection afforded to unemployed individuals and subject employers to civil lawsuits for discriminating against the unemployed.
