Prevailing Wage
What is it? By New Jersey statute (N.J.S.A. 40:37A-55.2 et seq.), each worker employed in the construction or rehabilitation of facilities undertaken in connection with work approved or financed by a public entity, shall be paid not less than the prevailing wage rate for the worker's craft or trade, as determined by the Commissioner of Labor and Workforce Development. This wage rate is set forth on the states website and is based upon not only the type of job performed, but the location and position of the employee.
Your employer is required by law to keep a true and accurate record of the hours worked by each and the wages paid by him to each and shall furnish to the commissioner or the director or their authorized representative upon demand a sworn statement of the same. Such records shall be open to inspection by the commissioner or the director or their authorized representative at any reasonable time.
By New Jersey Law you cannot discharge or discrimination against employee making complaint. Any employer who discharges or in any other manner discriminates against any employee because such employee has made any complaint to his employer, to the commissioner, the director or to their authorized representatives that he has not been paid wages in accordance with the provisions of this act, or because such employee has caused to be instituted or is about to cause to be instituted any proceeding under or related to this act, or because such employee has testified or is about to testify in any such proceeding, or because such employee has served or is about to serve on a wage board.
