Facebook, MySpace.com, LinkedIn.com all have one thing in common. They are all social networking sites that defense counsel are researching during discovery of lawsuits, and locating information that points out the inconsistencies in Plaintiff cases. For example – in an employment discrimination case, lawyers have located resumes on these social networking sites which are inconsistent with the resume submitted during the course of discovery. This evidence has been used to limit the plaintiff’s damages.
Additionally, in a personal injury case, a defense attorney obtained photographs of a plaintiff riding a horse after she alleged that she was injured on an inflatable slide and could no longer engage in horseback riding or riding ATV’s. The defense attorney found photos of the plaintiff on her MySpace profile engaging in both of these activities. The images obtained severely devalued her claims.
