Traffic tickets not only carry penalities imposed by the court but also may lead to additional fines and penalties from the New Jersey Divison of Motor Vechicles and your insurance company. If you get six or more points within three years on your current driving record, the NJ DMV will automatically assess you a surcharge. If you get 12 or more points on your current driving record, your license will be suspended. Insurance companies will charge anywhere from $100.00 to $200.00 per point on your driving record each year for three years. A speeding ticket of only 15 mph over the speed limit could cost you over $2000 on your insurance.

According to the statute, Unsafe Driving (N.J.S.A. 39:4-97.2) is very similar to Careless Driving except in one key area: Unsafe Driving prohibits the assessment of motor vehicle penalty points by the New Jersey Motor Vehicle Commission.

The Unsafe Driving plea can only be used two times within a five year period without being assessed points on your license by the NJ MVC. A driver who pleads guilty to Unsafe Driving a third time within five years will be assessd 4 points against them.
