Six female employees of Bayer HealthCare Pharmaceuticals have filed a class action lawsuit in the U.S. District Court in Newark on behalf of themselves and a class of female employees in the United States, alleging that Bayer has engaged in a pattern of unlawful discrimination against pregnant women and mothers. Specifically, the complaint alleges that Bayer has discriminated against these employees by paying them less than their counterparts, denying them promotions, limiting their job opportunities, and exposing them to different treatment and a hostile work environment.
The complaint alleges that Bayer unlawfully discriminated against these employees when it published and disseminated articles that suggest men are better suited to be managers than women, stating that females are prone to “mood swings,” “indecision,” and “backstabbing.” The complaint also alleges that managers at Bayer discriminated against the employees when it disparaged working mothers and stated that Bayer needs to stop hiring women of reproductive age. The plaintiffs are seeking declaratory and injunctive relief, back pay, front pay and lost benefits, as well as compensatory, nominal and punitive damages in an amount of $100 million or more.
